Terms of Service

1.

Overview

These Terms of Service (“Terms”) govern your access to and use of the curriq platform, including the website at www.curriq.com.au and the web application at app.curriq.com.au (together, the “Platform”).

curriq is operated by curriq (“curriq”, “we”, “us”, “our”), based in New South Wales, Australia. curriq is not currently a registered company; formal entity registration is in progress.

By creating an account, joining the waitlist, or using any part of the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2.

Eligibility and Accounts

2.1 Who May Use curriq

The Platform is intended for use by teachers, tutors, and school administrators working in an educational capacity in NSW, Australia. By registering, you represent that:

  • You are at least 18 years of age
  • You are using the Platform in a professional educational capacity
  • You have authority to accept these Terms on behalf of yourself and, where applicable, your school or institution

Students are not permitted to create accounts directly. Student access to the Platform (if any) is mediated through a registered teacher account.

2.2 Account Registration

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@curriq.com.au if you suspect unauthorised access.

2.3 One Account Per User

Accounts are personal to you. You may not share your login credentials with others or allow others to access the Platform using your account.

3.

Early Access and Pricing

3.1 Free Early Access

curriq is currently in an early access phase. During this period, the Platform is provided free of charge to accepted users. We reserve the right to introduce paid plans, modify pricing tiers, or end the free early access period at any time.

3.2 Notice of Pricing Changes

If we introduce paid plans, we will provide at least 30 days' written notice to existing users before any fees apply. Continued use of the Platform after the effective date of any pricing change constitutes acceptance of the new pricing.

3.3 No Obligation of Continued Access

Placement on the waitlist or acceptance into early access does not create a binding obligation on us to continue providing the service at any particular price or level.

4.

Permitted Use

You may use the Platform to:

  • Generate worksheets and exam papers for use with your classes
  • Submit student assessment responses for AI marking and feedback
  • Track student performance across NESA HSC syllabus outcomes
  • Manage classes and review assessment data

You may not:

  • Use the Platform for any purpose other than legitimate educational activity
  • Reproduce, resell, redistribute, or commercially exploit content generated by the Platform without our prior written consent
  • Attempt to reverse engineer, scrape, or extract our question bank in bulk
  • Circumvent any access controls or security features
  • Use the Platform to store or process sensitive personal information beyond what is reasonably necessary for academic performance tracking (see Section 7)
  • Impersonate any person or misrepresent your affiliation with any school or institution
5.

Intellectual Property

5.1 Our Content

All content on the Platform — including the question bank, syllabus outcome mappings, UI design, source code, AI models, and generated worksheets — is owned by or licensed to curriq and protected by Australian and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Platform and its outputs solely for your internal educational purposes. This licence does not permit commercial redistribution, sale, or sublicensing.

5.2 Your Content

You retain ownership of any content you upload to the Platform (for example, custom questions or class lists). By uploading content, you grant curriq a non-exclusive, royalty-free licence to store, process, and use that content solely to provide the service to you.

5.3 AI-Generated Outputs

Worksheets and exam papers generated by the Platform are provided for your educational use. We make no claim of copyright over AI-generated outputs delivered to you. However, you acknowledge that similar outputs may be generated for other users, and that curriq owns the underlying system that produced them.

5.4 Feedback

If you provide feedback, suggestions, or ideas about the Platform, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without obligation to you.

6.

AI Marking — Disclaimer

curriq's AI marking feature is designed to assist teachers by providing automated feedback on student responses. You acknowledge and agree that:

  • AI marking is not infallible. Outputs may contain errors, inconsistencies, or inaccuracies. You are solely responsible for reviewing AI-generated feedback before it is communicated to students or used in any formal assessment context.
  • AI marking does not replace teacher judgment. curriq is a tool to assist with, not to substitute for, professional marking decisions, particularly for high-stakes assessments such as internal HSC examinations.
  • NESA alignment. While we endeavour to align marking feedback with NSW HSC marking guidelines, curriq is not affiliated with, endorsed by, or approved by the NSW Education Standards Authority (NESA). AI-generated feedback should not be represented to students as official NESA guidance.
  • No liability for marking outcomes. To the maximum extent permitted by law, curriq accepts no liability for decisions made on the basis of AI marking outputs.
7.

Student Data

7.1 Your Responsibilities

By entering student data into the Platform, you represent and warrant that:

  • You have obtained all necessary consents, authorisations, or approvals required under your school's policies, applicable NSW and Commonwealth privacy law, and any parental consent obligations, before submitting student data to the Platform
  • You will only submit the minimum student data necessary for the educational purpose at hand
  • You will not enter sensitive information such as student government identifiers, health information, or disciplinary records

7.2 Our Role

curriq processes student data as a data processor acting on your instructions. We will not use student data for advertising, sale, or any purpose unrelated to providing the service. See our Privacy Policy for further detail.

7.3 School Data Processing Agreements

If your school or system requires a formal data processing agreement (DPA) or data sharing agreement before using the Platform, please contact us at privacy@curriq.com.au before commencing use.

8.

Availability and Changes

We aim to maintain a reliable platform but we do not guarantee uninterrupted or error-free availability. We may:

  • Take the Platform offline for maintenance, with or without notice
  • Modify, suspend, or discontinue any feature at any time
  • Update or change the question bank, AI models, or marking algorithms

We will endeavour to provide reasonable notice of significant changes that affect existing users.

9.

Termination

9.1 By You

You may close your account at any time by contacting support@curriq.com.au. Closure does not entitle you to any refund of fees paid (once paid plans are introduced).

9.2 By Us

We may suspend or terminate your account immediately if you breach these Terms, engage in conduct that is unlawful or harmful to the Platform or other users, or if we determine (in our sole discretion) that continued access is inappropriate.

9.3 Effect of Termination

Upon termination, your licence to use the Platform ceases. We will delete your account data in accordance with our Privacy Policy. Clauses that by their nature survive termination (including Sections 5, 6, 10, and 11) will continue to apply.

10.

Limitation of Liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law):

  • curriq provides the Platform on an “as is” and “as available” basis without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, consequential, or special loss or damage arising from your use of the Platform, including loss of data, loss of revenue, or reliance on AI-generated content
  • Our total aggregate liability to you in connection with the Platform will not exceed the amount you paid us in the 12 months preceding the claim (or AUD $100 if no fees were paid)

Nothing in these Terms limits your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, to the extent those rights cannot be excluded by contract.

11.

Indemnity

You agree to indemnify and hold harmless curriq, its officers, employees, and agents from and against any claims, losses, damages, or expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) your breach of these Terms; or (c) your submission of student data in violation of applicable privacy laws or school policies.

12.

Dispute Resolution

If you have a dispute with us, please contact us first at support@curriq.com.au and we will attempt to resolve it informally. If we cannot resolve it within 30 days, the dispute will be governed by the laws of New South Wales, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

13.

General

Entire agreement.
These Terms and the Privacy Policy constitute the entire agreement between you and curriq regarding the Platform.
Severability.
If any provision is found to be unenforceable, the remaining provisions continue in full force.
No waiver.
Our failure to enforce any right under these Terms is not a waiver of that right.
Assignment.
We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our prior written consent.
Governing law.
These Terms are governed by the laws of New South Wales, Australia.
