Disclosure of Personal Information
We do not sell personal information. We may share it with:
Service providers (sub-processors)
We engage third-party providers to help us operate the platform, including cloud hosting, database infrastructure, email delivery, and AI/LLM inference services. These providers are contractually bound to process data only on our instructions and to maintain appropriate security.
AI and machine learning providers
Student responses submitted for marking may be processed by third-party AI inference services (such as large language model providers). We take steps to minimise data shared with these providers and do not permit them to use your data to train their general models.
Regulatory or legal requirements
We may disclose personal information if required by law, court order, or a government authority, or where necessary to protect the rights, property, or safety of curriq, our users, or the public.
Business transfers
If curriq is acquired, merged, or its assets transferred, personal information may be transferred as part of that transaction. We will notify affected users in advance where practicable.
We do not otherwise disclose personal information to third parties without your consent.
Student Privacy and Schools
Because curriq is used by teachers in educational settings, and student data (including the work of individuals who may be under 18) may be entered into the platform, we treat student information with heightened care.
- Teachers and schools are responsible for obtaining any consents or authorisations required under their school's privacy policies, the Privacy Act 1988, and any applicable state education department guidelines before entering student data into curriq.
- curriq processes student data as a data processor on behalf of the teacher or school (the data controller).
- We will not contact students directly or use student data for any purpose outside the educational service being provided.
- If your school requires a data processing agreement (DPA), please contact us at privacy@curriq.com.au.
Data Storage and Security
All data is stored on servers located in Australia (or, where we use international sub-processors, subject to contractual protections equivalent to Australian standards).
We implement reasonable technical and organisational security measures, including:
- Encryption of data in transit (TLS) and at rest
- Access controls limiting staff access to personal data
- Regular security reviews of our infrastructure
No system is perfectly secure. If you believe your account has been compromised, please contact us immediately.
Data Retention
We retain personal information for as long as your account is active or as needed to provide the service. If you delete your account:
- Your teacher account data is deleted within 30 days
- Student performance data associated with your account is deleted within 30 days
- Anonymised or aggregated data (which cannot identify any individual) may be retained indefinitely for product improvement
We may retain certain data for longer periods where required by law.
Your Rights (Australian Privacy Principles)
Under the Privacy Act 1988, you have the right to:
- Access the personal information we hold about you (APP 12)
- Correct inaccurate, incomplete, or out-of-date information (APP 13)
- Request deletion of your personal information (subject to legal retention obligations)
- Complain about a breach of the APPs
To exercise these rights, contact us at privacy@curriq.com.au. We will respond within a reasonable time, and no later than 30 days.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.
International Data Transfers
Some of our sub-processors (including AI inference providers) may be located outside Australia. Where we transfer personal information internationally, we take steps to ensure it receives protections comparable to those required under the Australian Privacy Principles, including through contractual clauses.
Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform. Continued use of curriq after changes take effect constitutes acceptance of the updated policy.
